Terms and Conditions

Please read these Terms and Conditions of use carefully as they apply to anyone accessing the Site whether registered or not.
Recitals:
The 'Site' means the web site at www.Ulinx.co.uk
'You' and 'Your' refers to you as the user of the Site
'Member' means a user who has registered as a member in order to access content or services through the Site
'Advertiser' means a user who has registered as an advertiser in order to offer content or services through the Site
'Ulinx', 'We' 'Us' and 'Our' refers to Serversure Ltd., a company registered in England no. 2471000 - Registered Office: Station House, Wentworth Station, Barnsley S74 0ED, as the proprietors and operators of the Site
'Ulinx Account' means the notional account held by a Member or Advertiser for the purpose of transferring system credit
1: Acceptance of the Terms and Conditions of use
1.1 By accessing this site You agree to be legally bound by these Terms and Conditions of use.
1.2 We reserve the right to amend these Terms and Conditions of use from time to time and will display a latest revision date alongside the version available on the Site.
1.3 It is Your responsibility to read and understand these Terms and Conditions of use.
2: Age of Consent
By accessing this site You declare that You are 18 years of age or over.
3: System user name and password
3.1 Upon registration as a Member or Advertiser You will select a password and user name that You can use to access the secure areas of the Site including Your Ulinx account.
3.2 You are solely responsible for maintaining the confidentiality of your password and user name. We accept no responsibility or liability whatsoever for any loss or damages arising either directly or indirectly from the unauthorised or fraudulent use of Your user name and password.
3.3 You agree to notify Us immediately if you suspect that the confidentiality of your user name and password may have been compromised or of any unauthorised use of your user name and password or any other breach of security of which You become aware.
4: Your Warranties
You warrant that:
4.1 You will only use this site for legal purposes.
4.2 You are of a legal age to access adult orientated material of a sexually explicit nature as defined by the country or state in which you live and that doing so is not unlawful.
4.3 You are not offended by adult orientated material of a sexually explicit nature including but not limited to images and descriptions of sexual activity.
4.4 All information provided by You to Us is true and accurate at all times.
4.5 You will indemnify and hold Us harmless from any claim made by a third party in respect of any matter arising from Your use of this site or from any breach of these Terms and Conditions of use by You or Your violation of any law or the rights of any third party.
4.6 You will comply with these Terms and Conditions of use including but not limited to restrictions related to acceptable use.
5: Acceptable Use
As a user of the Site You agree that You will not;
5.1 Write or upload or transmit anything onto or via the Site that would cause offence or annoyance or anxiety to any individual or group.
5.2 Write or upload or transmit onto or via the Site any content that is likely to cause harm to children.
5.3 Write or upload or transmit onto or via the Site any illegal or indecent or offensive material.
5.4 Write or upload or transmit onto or via the Site any content that may incite disorder or encourage unlawful activities or is likely to cause harm to children.
5.5 Write or upload or transmit any material that infringes the copyright of any third party.
5.6 Impersonate another user of the Site.
5.7 Use the Site to conduct any fraudulent or unlawful activity.
5.8 Attempt to gain unauthorised access to another Member's Ulinx account whether successful in such an attempt or not.
5.9 Attempt to circumvent any of the Site's security measures whether successful in such an attempt or not.
You understand that We may;
5.10 Remove any Advertiser's profile (including photographs) or other material that, in Our sole discretion may be inappropriate or We suspect to be illegal or subject Us to liability or such that may violate these Terms and Conditions of use or where required to do so by law;
5.11 Issue Advertisers with written warnings and may take such further action as We deem appropriate under this paragraph if such warnings are not heeded;
5.12 Suspend or terminate any registered user's access to the secure areas of the Site including but not limited to the user's Ulinx Account without notice at any time;
5.13 Inform the appropriate authorities and provide them with information regarding any suspected illegal activity.
6: Copyright and Intellectual Property Rights
6.1 Your use of the Site grants no rights to You in relation to copyright, trade marks or other of Our intellectual property rights or the intellectual property rights of any third party.
6.2 You may not without limitation copy or republish or download or broadcast or commercially exploit or otherwise use the content included in or provided via the Site except for Your own personal non-commercial use.
7: Limitation of Liability
7.1 Nothing in this Agreement shall restrict Your statutory rights.
7.2 We do not warrant that the Site will be fully operational at all times or that any information provided via the Site will be free from errors or omissions.
7.3 Access to the Site and its contents may be suspended without notice in order for Us to carry out necessary maintenance or repair or for reasons beyond Our control.
7.4 All content and services on this Site are provided on an 'as is' and 'as available' basis. We do not make any warranty in respect of the Site or its content including without limitation to information provided by or regarding other users.
7.5 Any action taken by You on the basis of information provided on or via the Site is at Your sole discretion and risk.
7.6 We will not be liable for any damages including without limitation to indirect or consequential losses and whether in contract or tort or otherwise arising in connection with any use of the Site.
8: Security and Privacy
8.1 By registering on this Site You are opting in to receiving email and SMS communications from Us or Our agents or assignees. Do not register if You do not wish to receive such communications.
8.2 Content You upload to this site will not be published by Us in any third party web sites or printed media.
9: General
9.1 We shall not be liable for the temporary loss or termination of access to the Site or any content arising from a force majeure event. A force majeure event shall include without limitation a failure of infrastructure or government intervention or wars or civil commotion or fire or flood or accident or terrorist attacks or industrial action affecting Us or Our suppliers.
9.2 If any of the provisions in these Terms and Conditions of use are determined to be unlawful or unenforceable then all other provisions shall survive and continue to be binding and enforceable. If any unlawful or unenforceable provision would be lawful or enforceable if part of it were deleted then that part will be deemed to be deleted and the rest of the provision will continue in effect.
9.3 These Terms and Conditions of use shall be governed by and interpreted in accordance with the laws of England. Any disputes arising in connection with this agreement shall be subject to the exclusive jurisdiction of the courts of England and Wales.
9.4 All sexually explicit materials on the Site are produced and provided by third party Advertisers and are merely being distributed by Us via the Site. Any and all record keeping requirements imposed by law with respect to such materials are the responsibilities of the respective owners and producers of such materials.
10: Ulinx functions:
10.1 Credit Units purchased from Ulinx are not transferable and refunds will be considered on a case by case basis.
10.2 An Advertiser may have only one profile. Advertisers found to have created more than one will have their profiles deleted and will forfeit any credit remaining in their associated Ulinx Accounts.
10.3 Links to executables diallers or malware or other sites not related to an Advertiser's profile will be removed and may result in the deletion of the Advertiser's profile and a forfeiture of any credit remaining in the Advertiser's Ulinx Account.
10.4 We may from time to time issue Free Units for promotional purposes. Use of Free Units is not accrued to Advertiser accounts. Free Units may be used to purchase Gallary and Video access only.
11: Consequences of termination
11.1 We will determine what action is appropriate to be taken against a Member or Advertiser on a case by case basis.
11.2 Anyone found to be acting in a manner which in Our sole opinion is deemed to be outside the spirit of this Agreement or against the interest of Ulinx and its users will be removed and any credits they have accumulated in their Ulinx Accounts will be forfeited.
12: Images and videos
12.1 Any images or videos You upload must feature You or have been created by You or legally belong to You or have had the copyright assigned to You.
12.2 Images or videos featuring anyone appearing to be under the age of 18 in the sole opinion of Ulinx will not be accepted.
12.3 Images or videos featuring animals will not be accepted.
12.4 Images or videos with scenes of sexual violence which depict the occasioning of actual bodily harm or which in the sole opinion of Ulinx are likely to cause the viewer to be concerned for the safety or wellbeing of a participant will not be accepted.
12.5 Video clips uploaded to the Site must be between one minute and two minutes in length. If a video clip is less than one minute in length it will be rejected during upload. If a video clip is greater than two minutes in length it will be automatically cut to time without reference to content.
12.6 Advertiser's profiles must contain at least one free to view image.
12.7 Up to three images may be uploaded for free viewing in an Advertiser's profile.
12.8 The free to view images appearing in an Advertiser's profile must be of the Advertiser or the Advertiser must be prominent enough in the image as to avoid doubt.
12.9 Faces may be omitted or obscured in images and videos.
12.10 Pay-to-view secure galleries must consist of either ten or twenty images.
12.11 All images uploaded to the Site must be at least 600 pixels on its longest side and not have a frame added to reach this minimum size.
12.12 Images or video clips must not be duplicated anywhere on the Site.
13: Profile content
13.1 Premium rate phone numbers are not permitted in profiles.
13.2 Contact details including telephone numbers and email addresses and instant messenger usernames and links to other websites are only permitted in the fields of Advertiser's profiles specifically set aside for this purpose. It is not permitted to include such contact details in any other profile field.
13.3 Contact details will only be visible to users of the Site when the Advertiser has elected to have their profile marked as Active.
13.4 Text content which is considered in the sole opinion of Ulinx to be threatening or defamatory or discriminatory in nature or likely to bring Ulinx into disrepute will not be accepted.
